Adoption of General Local Law 2025

Notice is given that, at its meeting held on 25 November 2025, the Corangamite Shire Council (Council) resolved to make a local law titled ‘General Local Law 2025’ (the Local Law).

The following information about the Local Law is provided in accordance with s 74(4) of the Local Government Act 2020 (Act):

Purpose of the Local Law

The Local Law will:

  1. provide for and assure equitable, orderly and enjoyable use by people of community facilities, including roads;
  2. protect Council Property and other community assets from loss or unnecessary or avoidable damage;
  3. support provision by Council of a safe, clean and healthy environment in areas under its control and management; and
  4. provide generally for the peace, order and good government of the Municipal District.

General Purport of the Local Law

The Local Law will:

  • provide for the administration and enforcement of the Local Law and empower Council and authorised officers to issue permits, notices to comply, act in urgent circumstances and impound things;
  • provide for infringement notices to be served on a person who an authorised officer has reason to believe is guilty of an offence;
  • create offences relating to:
    • land which is dilapidated, unsightly or detrimental to the general amenity of the area in which it is located;
    • trees, plants, fences, signs or structures which overhang onto any footpath, obstruct the passage or a clear view of vehicles or signs and other traffic control items, or compromises the safe and convenient use of a road.
    • display of property numbers;
    • constructing, installing, removing or altering a vehicle crossing without a permit;
    • lighting or allowing to remain alight a fire in the open air in an Urban Area without a permit;
    • using an incinerator;
    • -occupying a caravan, tent, tiny house, moveable dwelling or motor home on private land without a permit;
    • keeping, storing, repairing or in any other manner using a shipping container on any land without a permit;
    • causing or allowing the discharge of mud, sludge, waste from private land onto any road or Council land;
    • discharging stormwater from private land;
    • animal management, including the maximum number of animals that can be kept on private land, the manner in which they are kept on the land, and the removal and disposal of animal faeces deposited in public places;
    • livestock management, including adequate fencing, allowing livestock to stray or wander unattended onto any road or Council land, grazing or droving of livestock without a permit, and the movement of livestock;
    • interfering with a water course, creek, gutter, drain, tunnel, bridge, levee or culvert without a permit;
    • destroying, damaging, interfering with or establishing any tree or plan on Council land without a permit;
    • defacing, damaging or interfering with Council land, buildings and assets without a permit;
    • lighting fires on a road or Council land without a permit;
    • using Council land for storage, leaving vehicles or other items on Council land for the purposes of advertising, ploughing or cultivating any road or Council land, or undertaking roadside harvesting without a permit;
    • conducting an event on a road or Council land without a permit;
    • placing a bulk rubbish/clothing container on a road or Council land without a permit;
    • undertaking building works, obstructing, interfering with or damaging a road or roadside without a permit;
    • erecting any hoarding, fencing or barrier that extends beyond a building site without a permit;
    • erecting any temporary or permanent fence or gate on any Council land without a permit;
    • camping on any Council land without a permit;
    • riding or leading a horse on a road or Council land in an urban area without a permit;
    • selling or offering for sale any goods or services on a road or Council land without a permit;
    • placing advertising signs, displaying goods, placing any outdoor dining furniture, or any structure for the purpose of selling or offering to sell any goods or services, on a road or Council land without a permit;
    • placing informational signs on a road or Council land without a permit;
    • soliciting or collecting any waste materials, gifts of money, or subscriptions from a road or Council land without a permit;
    • cleaning or doing any work to a vehicle on a road or Council land without a permit;
    • parking any Heavy Vehicle or Long Vehicle on any Council land without a permit;
    • doing anything on a road or Council land contrary to a sign erected by Council without a permit;
    • behaving in a way that causes harm or injury or which interferes with any other person’s reasonable enjoyment of Council land
    • consuming alcohol, or possessing or controlling any alcohol in an unsealed container between 10pm and 10am on any road or Council land, or in any areas specified as being alcohol free areas;
    • waste management, including using Council’s kerbside waste collection service, interference with mobile bins or hard waste, the use of public waste and recycling bins, and depositing waste at municipal landfill sites;
    • breaching or failing to comply with a condition of a permit issued under the Local Law;
    • failing to comply with a direction of an Authorised Officer;
    • failing to comply with a Notice to Comply issued under the Local Law;
    • failing to comply with a sign erected by Council;
  • provide a process for an application to be made for a permit, mandatory considerations and powers for Council to make a decision on a permit application, and powers for Council to amend, cancel or suspend a permit;
  • provide for Council to determine fees, charges, guarantees and bonds for the purposes of the Local Law;
  • provide for Council to exempt any person from the application of, or need to comply with, the Local Law;
  • allow a person to appeal to Council for a review of a permit decision under the Local Law;
  • require Council to maintain a record of permits and a register of determinations made and of guidelines or procedures prepared for the purposes of the Local Law;
  • provide enforcement powers to Council for issuing directions and notices to comply, and for seizing and impounding a thing which has been used or possessed in contravention of the Local Law.

The Local Law will commence operation on the day following publication of this notice in the Victoria Government Gazette. Copies of the Local Law and the Solicitor’s Certificate in respect of it may be inspected at Council’s Civic Centre at 181 Manifold Street, Camperdown, during office hours and on Council's website.
